Sometimes everybody’s gotta take a side

Real estate bloggers across the country- often referred to as the RE.net- know each other, read each other, communicate with each other, on a daily basis. I don’t blog about the RE.net here because so little of what happens there holds any real meaning to Dayton Ohio except that I’m a much better Realtor for having daily conversations with some of the most brilliant minds in real estate.

And I try not to use this blog to trot out various causes that I support. You don’t see many charities and no “cause” ribbons on my sidebar. It isn’t because sidebar widgets for causes don’t exist, it’s because I prefer to quietly support the things I believe in rather than screaming about it. Bandwagons annoy the heck out of me as they so quickly become a Cause du Jour, and I’ve always felt that this is not the place to climb onto my soapbox. Until now. Today I take a side.

There is a long and winding back road to this cause. The upshot being that a real estate blogger, Vlad Zablotskyy, is being sued by ePerks.com for writing about them. The fastest way to make some sense of this lawsuit is to take a look at it from a blogger who is not in real estate. Andy Beard is an outsider to the real estate industry, but he picked up Vlad’s story because he is a blogger and this story is important to all bloggers. Beard writes:

I am trying to be a responsible blogger. Over the last few days I have actually spent a considerable amount of time trying to avoid writing this post.

Most of my reviews are generally positive - if a company approaches me for a review and I feel that I have major concerns regarding their service, most often that will be expressed in email and we part ways, hopefully for the company to rectify the problems.

When I do write something negative, most often it is about specific features which if rectified, will make the product offering significantly better, or on occasion it is to offer differing opinion on a hot topic that is being extensively debated, and I will link through to differing opinion.

This is an ugly tale I don’t know every aspect, I doubt anyone does, but I have clocked up hours of research in writing this article, and it represents the truth as far as I see it.

I haven’t taken the opportunity of contacting ePerks or iHype directly - this article is not about their services, but primarily the way they have poorly handled their contact with the bloggers which has a significant bearing on how their newest offering, iHype will be accepted by the blogging community.

Vlad, from what I can tell, is no Donald Trump. Phoenix Realtor Greg Swann, host of the BloodhoundBlog, has been following this story for some time, and while I’m on the contributor’s panel on Bloodhound, I didn’t follow this story until today when Greg wrote:

Vlad is survivor of the Soviet Union, where liberty itself was throttled and where the smallest slip of the tongue could result in imprisonment or death. He had every good reason to think things were different in the United States, where the right to free speech is enshrined in our constitution. I hate the thought of anyone being coerced into silence by the abuse of our legal system, but if there is anyone who deserves better from America, it’s Vlad Zablotskyy. Glenn Reynolds wrote about An Army of Davids, but we are by now more like Cincinnatus — citizen soldiers who would rather farm than fight, and who, therefore, always fight to win. Together we can show Ben Behrouzi and every would-be tin-eared tyrant what comes of tyranny in the Web 2.0 world.

More than anything else, blogging is about sharing knowledge, information, and ideas. It’s about all of us connecting to make all of us smarter. This connectedness and shared knowledge has such power and potential- think of the implications! For the first time in history, millions of people are now able to collectively learn and share and grow and improve! This is why I blog. This. Is. Why. I. Blog. When a blogger is being sued to stop this flow of knowledge, I understand that it could happen to me. If you are a blogger, regardless of profession or blog focus, Chilling Effects could also happen to you. And should you find yourself outraged by censorship, and you should, the BloodhoundBlog has posted code so anyone can post the widget on their own blog. I encourage you to look out for yourself, by looking out for Vlad.

    Bravo, Teri. This lawsuit is petty and vindictive, but it will still have to be contested, at considerable expense. As you note, it could happen to any weblogger, and not just in real estate. This is a great thing you’re doing.

    The quick way to prevent robots visiting your site is put these two lines into the /robots.txt file on your server

    I would estimate they did this around October/November and didnt change it.

    Now ejerks go fire your webmaster and stop the stupid lawsuit its your webmasters fault not anyone elses.

    Hello Teri Lussier. I’m not a Realtor to be honest but I am a blogger and I agree that this is bigger than a niche - it effects all of us.

    As a geek I can talk on the robots.txt issue. It basically blocks all search engines (as the screen shot shows it) and that could amount to a loss of from around 75% up to 99% of traffic to the site. The exact figure differs from site to site and those numbers are just educated guesses.

    If I say that it would appear to me, as an onlooker, that they may, allegedly, have “issues”, would that get me in trouble I wonder?
